1.Fill out an injury report and ask for a copy for your records.
2.Be sure to note on the report any defective equipment, tools, hazardous or unsafe working conditions, or if another person contributed to the cause of the accident. Note weather conditions also.
3.List all eye witnesses and crew members on your report.
4.Take photos of the scene if possible.
5. See your doctor. Do not get treatment from a railroad doctor. You have a right to treat with the doctor of your choice. Be sure to tell your doctor how your accident occurred and what caused your injury.
6.You or your family members should not give a written or recorded statement to the railroad or claims agent and do not sign any releases or medical authorizations without legal advice.
7.Notify your union official of your injury.
8.Keep records of lost wages and other expenses.
